Man who says he was abducted by Taliban to be given new asylum hearing in Ireland

The man said he had been forced to work for a Taliban commander as a translator.

A 34-YEAR-old Afghani man, who claimed he was abducted by the Taliban in his home country to work for them, has won a High Court action against a decision of the Refugee Appeals Tribunal denying him asylum.

Justice Mary Faherty quashed the decision and transferred the case to the Tribunal for a new hearing.

Judge Faherty said the applicant, who cannot be named for legal reasons, claimed to be a Pashtun tailor from a northern province in Afghanistan and had been forcibly recruited by the Taliban in 2000.

As he spoke several languages, he had worked as a translator for a Taliban commander, and one of his tasks had been to ascertain, according to the language they spoke, whether Taliban prisoners were Shia or Sunni Muslims.

The applicant claimed that during the year he worked with the Taliban, the commander had been responsible for the disappearance of over 100 Shia Muslims, who were allegedly tortured or killed.

Judge Faherty said in a reserved judgement that the applicant claimed he had tried to assist Shia Muslims by putting them into a Sunni group but had been found out by the commander. He had been injured with a knife and threatened with death.

The man had eventually been released, but had again been sought out by the Taliban in 2005. They had come to his house and told him he was to accompany them the next day. The man had left his home that day and moved to another part of Afghanistan in order to escape the Taliban.

He claimed that while he was away, the Taliban commander was killed and families of the people who disappeared while in the commander’s hands had come to his father’s home and threatened to kill him.

He had later paid an agent more than €10,000 to smuggle him into Europe and arrived in Ireland in February 2008 where he applied for asylum. The Tribunal had refused his application on grounds of credibility.

Judge Faherty said the Tribunal had rejected the applicant’s claim to have been abducted by the Taliban and had found he had not shown that he would face persecution if he were to return in Afghanistan.

The judge said she was satisfied the Tribunal member had not considered all the information available regarding Afghanistan, as 2013 guidelines stated that people who resist Taliban recruiting are at risk of being killed.

Judge Faherty quashed the decision not to declare the applicant to be a refugee and remitted the case to the Tribunal for a new hearing before a different Tribunal member.

    If this claim is true:

    He collaborated with the taliban and now has the blood of 100 Shia Muslims on his hands, he is now about to become the responsibility of the Irish welfare system.
    Be mindful of that next time you pay your tax bill.

    I would have imagined the Taliban would not be the forgiving type. He helped Shia Muslims, was found out, got knicked with a knife and was let go?

    But then the Taliban, who he already betrayed said ” you know what we need? That guy who bettayed back in the fold again”.

    Sounds a bit suspect to me.

    There are plenty like him mooching around the country..this long road of court appeals is a scandal…Cant get my head around why we dont have just one legally binding appeals tribunal then out the door..its better for the tax payer, society and the asylum seeker as well to get it done quickly…know lawyers wont like it as they are sucking € out of legal aid..

    I know of a man who was a member of the taliban ran government in Afghanistan, he has been here for 7 odd years. He was allowed stay here as he went on hunger strike. Strange coubtry we live in.

    German soldiers who’s defence was that they were ordered to do what they did and could have been shot if they didn’t were not offered any leniency in the Nuremberg Trials for their participation in war crimes during WW2. This guy should be treated similarly. His story stinks!

    The Taliban sure got lenient and soft in their ways it seems. His story reeks and leaves our streets with one more shady character to lurk around play parks and swimming pools like his freinds in Germany.

    The legal profession in Ireland has a lot to answer for. Stringing along these spurious appeals at the expense of the Irish taxpayer.
    In effect this judgement and the number of appeals pending is giving the two fingers to those whose job it is to adjudicate on the merits of the applications presented.
    The case being discussed is basically a bundle of lies.

    Daryl ..was he one of the gang of afghans who staged a sit-in to the death in a church in dublin? There was,i think 28 of them demanding their entitlement to housing,welfare etc about 8 years ago.

    The muslim “asylum seekers” really exploit our “useful idiots” and wilful stupidity/ignorance…sunni and shia muslims can spot each other miles away..boths sects hate each other and dont need any more than the briefest of looks to classify each other.

    That has to be the stupidest comment I have heard. Not to comment on the case itself, but the idea that Muslims have some sort of radar detector that they can automatically identify one another as Sunni or Shia is ridiculous.

    And…shia is not a language or dialect..nor is sunni…most afghans whether sunni,hazara,tajik,shia,pashtun…speak the same language – pashto.was EVERYONE in court involved in this case on the same side? The freeloaders?

    I’ve flown over Afghanistan a couple of times, it’s quite some distance, how did he end up half way to the US when if he’d simply traveled east he would have been there in half the time?
