Court approves €1.6m interim settlement

Award for child born with severe cerebral palsy.

THE HIGH COURT has approved an interim settlement of €1.6 million for a four-year-old girl born with severe cerebral palsy. The National Maternity Hospital was being sued by Charlotte Barry, 4, through her mother for negligence and breach of duty.

Ms Barry from Bath Avenue, Sandymount, Dublin, was born severely disabled at the Holles Street maternity hospital in 2005. The court heard that her mother had attended the hospital on 28 August 2005 after her waters broke, but was discharged and not admitted again until 8 September. She claimed the hospital was negligent in allowing the pregnancy to continue unmonitored and for the delay in her admittance.

The hospital admitted liability and a part settlement was reached. It was agreed the child could come back to court for further payments pending legislations changes to allow for it.
