Man charged with dangerous driving causing death of dad-to-be

Brian Cleary appeared at Naas court this week.

A MAN APPEARED before Naas District Court charged with dangerous driving causing the death of a man whose wife was due to give birth just a few months later.

David Scully, a 33-year-old bull dog exhibitor from Swords, Dublin, died when a jeep collided with his motorbike on 12 August 2015, at Blakestown Lower, Co Wicklow.

On Thursday, 51-year-old Brian Cleary of 12 Sycamore Close, Cabinteely, Dublin 18, appeared at Naas District Court. Evidence was given in court that Cleary had no insurance or driving license. Failure to produce a driving license was added to the charge.

An application was made by Inspector Mel Smyth for the matter to be adjourned, adding that there was no issue with him standing trial.

Judge Desmond Zaidan ordered that Cleary is sent forward to Wicklow Criminal Court at Bray on 26 September to be tried before a jury.

Judge Zaidan warned Cleary that if an alibi forms part of the defence, then he has 14 days to give the details to prosecution.

When Judge Zaidan asked Cleary if he understood that there are no issues in relation to him standing trial and that he must not use mental illness as part of the offence, Cleary said, ‘I do yes.’
