A LAWYER SAID today she has submitted the arguments during the first day of a hearing where two men are seeking a Kenyan court ruling to stop enforced anal examinations of men accused of being gay.
Sande Ligunya said she argued the anal exams infringe on the right to privacy and the right to a fair trial.
She said her clients were arrested in a bar near Ukunda along Kenya’s Indian Ocean coast in February 2015 on suspicion of engaging in gay sex which is a criminal offence in Kenya.

The men were forced to undergo anal examinations after a magistrate ordered a medical examination, she said.
The attorney general is expected to respond to their petition next week, Ligunya said.
Human rights groups have condemned the examinations.
“Such examinations without consent or medical cause are an absolute violation of the privacy not to mention bodily integrity,” said Muthoni Wanyeki, Amnesty International’s regional head.
The strongest possible message must be sent to medical professionals about it.

I think the world and humanity move constantly forward and eventually arrive at the same destination. This is the first test case that opens a debate on attitudes to homosexality in Kenyan Society which is a progressive step.
We look with distain at their position whilst coviently overlooking our own recent journey regarding this subject.
Homosexuality was until relatively recently a criminal offence in this country and gay men were frequently targeted and seriously assulted. These attitudes have not totally disappeared and will perhaps take another generation or two to be finally confined to history.
My own attitude has matured over time from the ignorance of growing up in the 80s to the enlightenment of today and I’m a better person for it.
We can’t just think “oh we did sh* t in te past so now they get an excuse to do sh* t too.
Our past migt be shameful, but we progressed and it’s time to stop making excuses for human rights violations in places like Kenya and just outright shame and criticise them!
What consenting adults do together is entirely their own business. What right has anyone to condemn them when they’ve harming nobody. Some people still live in the dark ages

In fact a lecturer at my Uni worked with sex offenders in Broadmoor hospital and they had to find a non invasive way to test female offenders for sexual preferences and proclivities as they could already do this with males using a ring shaped device. They risked an appeal and possibly having to let a prolific female offender go if they couldn’t offer the same treatment and testing as they did for males so they devised a method for females that was non invasive. So it is seen as a breach of rights to conduct invasive exams against a person’s wishes yet these clowns think it’s a laughing matter. Would make you feel sick.

On most ongoing court cases – home and abroad – the journal normally has the comments closed. A cynical person might think this one is open so that people post controversial comments. But I’m not cynical. The journal would not stoop to such sad levels to increase clicks into articles.
