A BRAZILIAN MAN who left a young woman severely injured in a lane way after raping and assaulting her has been jailed for 13 years.
Rafael Tiso (31) was captured on CCTV leaving a nightclub with the intoxicated victim and walking with her down a side street before going into a lane with her. He left the lane 40 minutes later and returned to drink in the same bar for over an hour.
A passer-by heard a moaning noise and discovered the woman lying on the ground between a truck and a car with her legs spread apart. The man believed the woman was dead at first as her eyes were closed and he did not want to touch her to contaminate the scene.
He saw blood on the ground beside her. The woman’s clothing and hair were soaking wet. Gardaí were alerted and the woman taken to hospital.
The 23-year-old victim, who can not recall anything of the incident, suffered a deep tear to her rectum.
Guilty plea
Tiso, who was living in rented accommodation at Offaly Road, Cabra, Dublin pleaded guilty at the Central Criminal Court to rape, oral rape, aggravated sexual assault and assault causing harm to the woman at Montague Lane, Dublin on 18 January 18. He has no previous convictions and has been in custody since his arrest.
Ms Justice Isobel Kennedy said that this was a violent and callous crime perpetrated on a vulnerable inebriated young woman. She said the victim’s restrained impact report showed how the attack would affect her for the rest of his life.
She said the fact that Tiso had left the woman in such a dreadful state and the severe emotional and mental impact of his attack were aggravating factors.
She suspended the final year of a 14-year sentence on condition that Tiso leave the State on his release for a period of 10 years.
Garda Chris Fitzgerald told Martina Baxter BL, prosecuting, that the woman had been socialising in a nightclub and was described as very intoxicated and incoherent. She had taken an ecstasy tablet.

She was seen on the CCTV being escorted out by security and accompanied by Tiso, who helped her out of the club. A young man passing by about 40 minutes later discovered the woman in “a shocking condition” in the lane way, Ms Justice Kennedy said.
Hospitalisation
Tiso had returned to the nightclub and remained there for a further hour and a half. The woman was taken to hospital and staff were concerned that she may have been sexually assaulted. She had no memory of events, only recalling being in the nightclub and later seeing a flashlight in her face when she was found.
The young woman was found to have a tear to her rectal region which required surgery. She also had numerous lacerations and bruising. Gardaí began an investigation and recovered the CCTV footage showing Tiso with the victim.
Tiso, who was working as a rickshaw driver in the Harcourt Street area, was nominated as a suspect and interviewed. He claimed he had consensual sex with the woman.
Tiso told gardai in his final interview that he really regretted taking advantage of her. Ms Justice Kennedy noted that his expression of remorse was motivated to a degree by remorse for how these events were impacting on his life.
Ms Justice Kennedy said the physical damage caused to the victim was appalling. She had been advised that she should not give birth naturally in the future as a result and she may also suffer complications at menopause.
In her victim impact report the woman said “something terrible happened to me” and described it like being “an episode of a horror series.” She said she sometimes felt as if she is in a nightmare and tried not to think about what happened.
She said she would like to “delete that day” and described “a daily fight between going forward or making a martyr of myself”.
Caroline Biggs SC, defending, said Tiso came from a small town in Brazil where he worked hard in school and college before securing a job in a bank. He continued to study for a masters at night-time before coming to Ireland to study English.
She said Tiso had been on anti-anxiety medication at the time and had been working long hours. She said he had been isolated and alienated from his family.
A psychological report concluded that he was at a moderate to low risk of re-offending and that he didn’t have an inappropriate attitude towards women. Letters from former girlfriends spoke of normal sexual and respectful relationships.
Biggs asked Ms Justice Kennedy to accept that her client’s actions on the night were “utterly out of character” and suggested that he may not have been used to drinking heavily and had eaten very little that day.

Why is deportation considered a punishment, the state owe this lady some retribution in the form of imprisonment and he def shouldn’t get a chance to return to his family during it
All crimes like this are bad but… 13years for rape & only 6years for fatal stabbing of Luas driver? (associated article at end of this report). Doesn’t seem like balanced sentencing to me.
This is as bad as the fatal stabbing in my eyes. He led her out of a nightclub when she was drunk, pretending to help her knowing exactly what he was about to do. It was calculated and thought through. The stabbing was done in anger. Someone lost their life but by the sounds of the article this girl would have too if that guy hadnt found her so quickly and your man was in having another drink. Shocking.
@James Maloney: The two men were fighting and one of them got stabbed and then died. In this case, a woman was viciously attacked, who wasn’t participating in anything that could knowingly lead to her death/harm.
@Paddy Byrne: Wouldn’t it make more sense to remind the men reading this to just not rape women rather than telling women to be careful and police their behaviour so they don’t get attacked?
@Veronica while I agree this woman is a victim and not responsible for her assault and rape at all. What you said makes no sense. Why not tell burglars not to rob rather than people to lock their doors. Of course we should be able to leave our doors unlocked but sadly there are bad people out there and we need to do what we can to protect ourselves. Locking doors and being aware of personal safety are a necessary evil.
@Barry Davidson: I understand your sentiment, but the idea that rapists are “bad people” like burglars and other criminals is kind of false. Rapists are among us, and sadly they’re most likely to rape their friends or family members.
The idea of “lock your shit up so you don’t get burgled” doesn’t really apply to rape because statistically you’re far more likely to be raped by the person you trust who is walking you home than a stranger as in this case.
I only used bad people because the app wouldn’t list me use the word s cum. I think your catchphrase over simplifies this horrible crime and risks causing more harm than good.
@Barry Davidson: Fair enough, but I disagree. I don’t think the way to reduce the rates of sexual assault is to keep telling women to hide themselves away, I think it’s to increase awareness of things like consent and sexism (that gives some men the idea that they’re entitled to sex with women, even if the women don’t want it).
Telling women how to not be raped is kind of implying that it’s an inevitability, like earthquakes or storms or something. Besides, it’s a crime that’s motivated by a desire for power, not to make money like burglary usually is.
You see that’s a straw man you’ve built there; no one says women should hide themselves away. Women and men SHOULD be able to stand naked in a dingy unlit ally way but I wouldn’t advise it even if every person going into the ally was told not to rape. We can do both teach people about responsible sex like consent etc but also teach them ways to stay safe in case they do meet rapist who doesn’t care about the consent lessons.
No matter what way you dress it up you have just blamed that victim for her own rape. So how drunk can we get? How short can our skirts be? What time should we be home for? Or should we just teach men about rape, consent and respect.

As bad as it may sound, the LUAS driver’s suffering is over. Maybe not for his family, but for him its over. This woman will have suffered, and will suffer far worse.
@Hupthejaysus: The bar where this woman was drinking should be in court for allowing this woman to get in such a state.As soon as she could drink no more she was escorted off the premises by security and they should have made sure she was in safe hands before letting her go
The defence is so pathetic. He’d been drinking and hadn’t had anything to eat. It’s sounds like a sick version of that snickers ad. “You’re not yourself when you’re hungry”. I’m not trying to be funny or disrespectful it genuinely is that pathetic. I’d say his counsel knew he hadn’t a leg to stand on. Vicious man deserves more. Poor girl. Awful.

@Teresa O’Brien: He will get 25% remission, so he will serve 9 years and 3 months if my maths is correct. Sex offenders are not entitled to early release ( aside from remission ) and they do not qualify for the 33% remission that some other offenders get. At least for now.
Feel so sorry for that girl…hope she can get on with her life now…..He’s a brazilian so he has no automatic right to be here..after prison chuck him out for life and contact brazilian police so he has it on his record there as well..the abuse of the english colleges here is a joke..these courses last for years if the students have the money..its only an excuse to work and reside here
