Temple Bar Photocall Ireland

Woman was seriously assaulted in Temple Bar - but left scene before gardaí arrived

Passers-by came to the aid of the woman – and gardaí have issued an appeal for information.

GARDAÍ ARE APPEALING for witnesses to a serious assault that happened in the Temple Bar area of Dublin last weekend.

It happened at around 3.40am on Saturday morning at Bedford Lane, close to Aston Quay.

Gardaí received reports that a woman was assaulted by a man – but it’s believed she left the area before officers arrived.

According to a statement:

“It is believed that the woman was knocked to the ground during the incident before members of the public came to her assistance.

“There were a number of witnesses to this incident and a number of people have been interviewed in connection with this investigation.”

Investigating gardaí are asking the woman or anyone who may have information to contact them at Pearse Street Garda Station on 01 6669000, to call the Garda Confidential Line at 1800 666111 or to contact any Garda station.

The area would have been relatively busy at the time, as people made their way home from Friday Christmas parties.

Because she may be in an abusive relationship where she fears retribution from her partner.

The partner in question should still be prosecuted if they (which they clearly have) broken the law.

Why am I explaining this? Does your missus know her place Aido?

DPP can bring about charges for any crime regardless of impact statement if there is enough evidence. CCTV would be one.

CCTV footage can be used in a public order offense. As it has been numerous times before.

Honestly, even without extensive knowledge of the law common sense should prevail.

My understanding is that in cases of physical or domestic attack you need the victim to press charges, in public order cases the guards can press charges for indecent exposure for example. Please correct me if I’m wrong.

Yer man Charlie and his wonderful “factual statements” about prosecuting people with CCTV footage only is LOL stuff. Charlie can you list one just ONE CASE of assault that was prosecuted without the victim. Come on now or else you have to admit on here you’re a waffling no clue g@bsh|te

Molly the fact he he thinks a victim impact statement is part of a prosecutions case and also the fact he cannot even spell “offence” correctly is just an indictment the level of moron you’re dealing with.

Jaysus Aidan…you cut me real deep. I could be wrong. I will admit it. The way you present your argument it doesn’t seem like you are a student of law. You call people “spastics” and tell people to stop using the internet. Yet I am the troll.

“thinks a victim impact statement is part of a prosecutions case” They are read out in court ALL the time. Of course they are part of it. How is that not part of it?

    http://www.irishtimes.com/news/crime-and-law/courts/court-halts-trial-of-man-on-public-order-charges-after-garda%C3%AD-lose-cctv-footage-1.1705920

That is a public order case where there were no witnesses. The fact the CCTV footage was lost meant the case feel apart. Meaning?..The whole thing hinged on the footage. So you are not spot on with it having to be a witnessed by a Garda are you? Molly was spot on.

Now I know in some cases if a victim does not come forward for a crime nothing can be done but say if the man in the story had priors. Could the witness report, with CCTV footage, be used then?

Or if nobody ever makes a complaint about an individual they can just keep assaulting people?…..As long as nobody brings a complaint? I just don’t believe that to be true.

To prove a case you need evidence.
You need person A to say Person B punched me. Without that there is no case.

A victim impact statement is nothing nada nothing zilch to do with a prosecutions case. It is read out at the sentencing hearing after & if a conviction:guilty verdict has been secured

Aidan, all complaints of alleged assault made to the gardai have to be investigated. CCTV is invaluable in these circumstances it enables the guards to determine if an assault did in fact take place and also the identities of those involved, they can also determine the circumstances of alleged attack (random, domestic etc.,). If, when questioned the victim refuses to press charges a personal assault prosecution cannot be made, however, if the gardai determine that there is sufficient evidence (CCTV and witness statements) to warrant further public offence charges, then they will prepare a file to be passed to the DPP who then will determine whether these further charges are warranted. So, both yourself and Charlie are correct, albeit on different points. Honest and open debate (where each can learn from the other) without resorting to insults is always much better, don’t you think?
