Uefa and Fifa bid to block Super League broke EU law, court rules

The European Court of Justice ruled against the football governing bodies.

THE PROSPECTS OF a future European Super League have been boosted after judges said Uefa rules blocking the formation of such a competition were contrary to EU law.

The Grand Chamber of the European Court of Justice had been asked to decide whether Uefa and Fifa acted against competition law by blocking the formation of the European Super League in 2021 and then seeking to sanction the clubs involved.

The court has ruled that Uefa and Fifa rules granting prior approval for new competitions are contrary to EU law.

A release issued by the court said such rules were “contrary to competition law and the freedom to provide services”.

The court release added: “There is no framework for the Fifa and Uefa rules ensuring that they are transparent, objective, non-discriminatory and proportionate.

“Similarly, the rules giving Fifa and Uefa exclusive control over the commercial exploitation of the rights related to those competitions are such as to restrict competition, given their importance for the media, consumers and television viewers in the European Union.”

Twelve clubs – including the Premier League’s ‘Big Six’ – announced the formation of the original European Super League in April 2021 but the plan quickly collapsed amid fan protests, pressure from Uefa and Fifa and even opposition from the British Government.

But now the ECJ appears to have given the green light to any such competition being relaunched in future.

“The court observes that the organisation of interclub football competitions and the exploitation of the media rights are, quite evidently, economic activities,” the court release continued.

“They must therefore comply with the competition rules and respect the freedoms of movement, even though the economic pursuit of sport has certain specific characteristics, such as the existence of associations having certain regulatory and control powers and the power to impose sanctions.

“The court also observes that, in parallel with those powers, Fifa and Uefa themselves organise football competitions.”

Bernd Reichart, the chief executive of Super League promoters, A22, said on X: “We have won the right to compete. The Uefa monopoly is over. Football is free. Clubs are now free from the threat of sanction and free to determine their own futures.”

Reichart also pledged “free viewing” of Super League matches to fans, though it was not immediately clear whether this meant for those watching in stadiums or on television or other platforms.

He said revenues and solidarity spending were “guaranteed”. A22 is set to hold a live streamed event in Madrid at 11am UK time.

The court held that where an undertaking, such as Uefa, holds a dominant position and has the power to determine the conditions in which potentially competing undertakings such as A22 may access the market, that power must be subject to criteria which are suitable for ensuring that they are transparent, objective, non-discriminatory and proportionate.

It found Uefa and Fifa’s powers were not subject to any such criteria and that those organisations were therefore “abusing a dominant position”.

Uefa issued new authorisation rules for promoters wishing to launch new competitions in June 2022.

However, they appear on the face of them to preclude the creation of a rival competition because they contain cumulative conditions designed to prevent the adverse functioning of their existing events such as the Champions League.

The court found Uefa’s rules on approval, control and sanctions must be held to be “unjustified restrictions on the freedom to provide services”.

The court said this did not mean the specific Super League project proposed in 2021 would necessarily be approved. It was asked for a ruling on Uefa and Fifa’s rules, but by finding them contrary to EU law, the case will now go back to the Madrid commercial court for a decision. In any case, those behind the Super League have now redesigned their proposal and therefore are not expected to be seeking approval for the format put forward in 2021.

In parallel, the court observed that Fifa and Uefa rules relating to the exploitation of media rights are such as to be “harmful (to) European football clubs, all companies operating in media markets and, ultimately, consumers and television viewers, by preventing them from enjoying new and potentially innovative or interesting competitions”.

Uefa issued a statement taking note of the court’s decision but insisted this was not “an endorsement or validation” of the Super League.

It remains confident that its 2022 authorisation rules governing the formation of new competitions are robust and “specifically that they comply with all relevant European laws and regulations”.

Fifa, the Premier League and Football Supporters Europe have been contacted for comment.

    FIFA and UEFA were running a monopoly.. they had no hope in the european court.. i am not upset in the slightest… !

    @John Bathe: Really John, so replace one bunch of sucking leeches for another group. For me the CL format from next season is a quasi Super League, you add this to the mix and you’ve got drive thru, fast food football on speed played in Doha and Mumbai. I don’t want to see Liverpool play Bayern Munich every season (played only 2 times, 81 and 19 in UCL) there’s no jeopardy, there’s no risk, Legacy fans to Perez and the Glazers, jog on…so this is the future, nah, I’m out.

    @Marcus Maher – Triskellion Films: ah no i agree. New, crowd will be no better… football has sold itself to the highest bidder before and will do the same for a new bidder..

    A big motivator for the clubs will surely be the chance to play less games in a smaller league on top of the extra buckets of cash of course. Total saturation at this stage. Rarely a break to give people a chance to miss it. Many stretches during the year where it’s practically on every single day. You can see the fatigue affecting games already. Huge games that limp along with players at 70%. They may be on huge money but they’re human and there’s only so much physical and mental energy you can squeeze out of people.

    @SerotoninWars: you say that but there’s a massive gap in the summer , league of ireland and gaa fills that slightly but the Premier league, champions league etc… I agree there’s too many games for the but it fills the week for fans, something new every few days with no guaranteed outcome. The super league would be the beginning of the end of it for me I feel, especially if its ring-fenced. The club world cup also feels like another hollow tournament.

    @Butters: There’s also every second year where there’s internationals like the Euros and World Cup plus Nations League etc which means it’s almost all year round. Don’t get me wrong I’ll be glued to the Champions League when the knockouts begin but it’s all of the competitions added together that leave the players absolutely shattered. You can see it in some of the games where traditionally it would have been full pelt and they’re just not firing on all cylinders after travelling and playing more internationals during ‘the break’. I’m not claiming to speak for everyone but I know a lot of people would rather see less games but better quality with players who aren’t operating below their best. The expanded Champions League and proposed World Cup every second year would just add to this.

    @SerotoninWars: The internationals are a bit of a joke though, no where near as exciting. I might watch an ireland match but other than that I don’t care about England v hungary or Serbia v France, especially the nations league. The euros is probably the best competition although they’re messing with that now too.
    I think we’re more or less on the same page though, players are getting flogged.

    @Butters: I hear you. Some of the internationals are the kind of games where you’ll be regretting wasting those two hours on your deathbed! Awful stuff a lot of the time in the qualifiers. Agreed, FIFA and UEFA are shooting themselves in the foot. The clubs are spending nearly all the money and being rinsed. Hardly anyone wants to see a Super League but they’re giving the clubs so much ammo.

    @ecrowley ecrowley: I’d also imagine that Sky don’t want it. That is part of the reason so many ex players turned pundits came out against it.

    It wasn’t the courts ruling that caused it to not go ahead, it was the public uproar. The fans. I don’t think this will make any difference there will be no Super league in the foreseeable future.

    @Brendan Devlin: The eu law apply’s to UEFA and FIFA is governed by Swiss law but the EPl conforms with both Swiss and EU law .
