Aviva says 'suspicious' personal injury claims are being withdrawn on the steps of court

New internal analysis by Aviva said fraudulent claims are a “huge cost to insurers, motorists, and society”.

OVER 90 INDIVIDUALS who initiated legal proceedings with Aviva, seeking compensation for a personal injury claims, withdrew their cases in the last two years according to the insurance company.

New internal analysis by Aviva Insurance Ireland found a trend of some personal injury claims being withdrawn “before on or on the steps of court” which the company claim is a “huge cost to insurers, motorists, and society”.

The company has undertaken an analysis of some 800 claims over the past two years which it suspected of being fraudulent or exaggerated. 

The insurance company identified that 91 claims were withdrawn before court proceedings in the years 2021 and 2022.

Senior Fraud Manager in Aviva Rob Smyth said: “The emergence of this trend is further evidence that there continues to be a cohort of individuals who are willing to fake accidents and personal injuries in the hope of receiving a generous pay-out from the courts.

“Unfortunately, these claims continue to be a major cost to the insurance industry, to our customers, and to society at large,” Smyth added.

Smyth also said today that Aviva “had a further 70 suspected fraudulent claims that were dismissed by the courts. Defending these cases cost the company in the region of €2 million.” 

The company said that the investment by Aviva and other insurance companies to investigate and dispute these claims is having “some positive impact” due to the trend highlighted by their analysis today.

The Alliance for Insurance Reform called on the government last year to do more to tackle the premiums as new guidelines, introduced in 2021, made awards for personal injuries fall by 40%.

The Alliance said the reforms were “clearly not having an impact” on the liability premiums paid by businesses, voluntary and community groups and charities.

It surveyed those 954 of those organisations and found that 42% of organisations say that insurance premiums were threatening their future and 90% told them the Government was not doing enough to address the issue of insurance costs.

The Personal Injuries Assessment Board (PIAB) found that personal injuries were €118 million lower in 2021, compared to 2019, when the guidelines were introduced.

The new guidelines outlined a range of possible amounts of compensation for personal injuries of which the courts and the PIAB must consider in all cases.

However according to the 2023 mid-year Private Motor Insurance Report from the Central Bank, the average earned premium per policy decreased by 5%. The report also found that premiums have fallen by 18% since 2018, as of the first half of 2022.

Last year, the annual report found premiums fell by 17% between 2017 and 2021

Smyth said insurance fraud remains a “burden on our customers and on society” and that the company is will continue to investigate claims they suspect are fraudulent.

“We have an experienced team of in-house investigators and have invested in fraud analytics, along with the latest automated fraud detection technology,” Smyth added.

His point is valid, DUP are a disgrace up north, many unionists are disillusioned with them, SF unfortunately arent worth much there either, the north have no real parties thats outside of the ‘us or them’ attitude and many people have moved on from that with nowhere to turn to politcially, similar enough to ourselves down here really ff or fg, ff feck is over fg get in, then they fe k us over and ff are back with no real party inbetween.     @Chris OB: whatever they faults of Irish government they are far superior to anything in North, with possible exception of some of the Alliance. The two most popular leaders in north now are Naoimi Long and Leo Varadkar. That is very telling for Sinn Fein, DUP, UUP, and SDLP.

    @Peter McGlynn: wasnt it Varadkar that had the chat with Johnson? What I mean is id think Leo played a blinder in getting special status for Northern Ireland aswell as Anderson doing her bit at EU level. Either way, I wouldnt vote for either and my point stands, politics in this country is a bit of a joke, thats not to say they havent done well in this instance but then, everybody is capable of good deeds at one point or another.

    @Thomas Quinn: There is a large spinner thrown into the works by a remain MP which if chosen for debate by the speaker of the house will be another “delay” scuppering any possibility of a decision today. Tories should have expected something like this last minute attempt to push fo “another” extension and the whole bloody thing will meander off again on its marry way to nowhere . The Scots and Welsh are opposing it on the grounds that Northern Ireland is getting more sweetheart deals than they could ever dream of . The green eye of the little GreenGod of jealousy at work here.

But If there is an extension and a new election Boris will put his deal in his manifesto and landslide it with this. Corbyn can’t dither forever He is a disgrace to the labor movement. If there is an Election the DUP are in for the shock of their political lives. Good on ya Boris ya had the guts to finally tell them to go back to 1690 an epoch they have never left.

    If it doesn’t pass then it will go for an extension and hence an election. Then more that likely another referendum. Wonder if the DUP would canvass to stay in the EU this time. They got it badly wrong the last time and got burnt.

    @Stephen Brady: it’s not his call to make though, That decision would have to be agreed by the EU27. And I doubt Germany for instance, would be of the same mindset. His comments came across more like a tactic to divert people from even countenancing the idea of an extension. Junker’s shift is nearly up, and he wants to sign off on it before he’s out the door.

    @Stephen Brady: It’s quite possible that Boris conceded to May’s version 1 warmed-up deal as a trade off to ‘no extension’ … Johnson just had to re-brand it, stick a simple majority vote on NI’s say, made it sound like a complicated re-hash of the original deal and re-named it ‘the protocol’. Bingo

    All about keeping UK in EU. EU know this hasn’t a snowballs chance in hell. BJ knows also. Election and BJ will blame Corbyn and co..
    Romp to victory and next deadline which EU will inevitably give will see BJ in a stronger position and demanding more . So tomorrow BJ will put deal or no deal to parliament. No deal wins convincingly. BJ goes to the people blaming everyone. Gets majority. His plan all along. Meanwhile our chaos are busy giving up backstop and their best cards… Couldn’t make this up..

    @Conoroconnor: Have you heard the EU say there will be no extension after a no to this deal? If course not. Guaranteed. They want a no deal. This cannot work from a republican point of view either . A vote every few years!
    DUP for some reason get a majority of veto worse, then a border is put on our island.

    @Willy Mc Bride: Just from your first comment, “Johnson will put deal or no deal to parliament.” This is absolutely impossible in the context of UK parliament. Only motions with a yes/no answer can be put before parliament. Johnson can ask two separate questions “Will you accept this deal?” and “Will you accept no deal?” but parliament can still say no to both of these. Constraining parliament to a one or the other question is just not possible as they can only vote yes or no.

    @Vincent #SaveDaredevil: and (apart from polarisation in the UK) nothing has changed. After deal – nothing has changed – except, strangely, NI having the same vat rate as Ireland, which they don’t have now as both a member of UK and EU. Come December you will still be able to drive to Newry and get your shopping and vice versa. No one will stop you, while the DUP and SF will carry on their version of sectarian division.

    If labour had courage or at least conviction they would get a second referendum amendment passed then pass the deal. Then they could saddle Boris with his deal allowing him to be attacked from the right by the DUP and Nigel and hopefully get enough damage done to them to win the next election after the referendum. Don’t think it will happen though. Corbyn is a dedicated fence sitter no matter how barbed the fence becomes.

    @Stephen Brady: actually the EU clarified last night that an extension is not off the table but it would have to be for a purpose. I kind of wish they had not said that until after Saturdays vote so as to put pressure on getting this deal passed but at least it means no deal and enconomic and political disaster is less likely

    @John: It is almost exactly the same as May’s deal. Originally the EU proposed a border in the Irish sea and May altered it to a UK wide backstop to please the DUP. Boris has done exactly what the EU suggested in the first place, it’s not a great new deal or a stroke of genius. It is Boris capitulating to the EU and spinning it has a great achievement. The only other things that has really changed is that EU worker’s rights has moved from legal part of the text to the political declaration part of the text, in other words the UK can renege on that on a whim and the mechanism by which Northern Ireland can exit out of the customs union, which if they did would land us back with the same border problems. https://youtu.be/zXMAg_wScfA

    I really don’t know what the alternative is. An extension, an election or even a new referendum will achieve nothing. The country is completely divided and the results of an election or referendum will only reflect that divide. Farage is not happy at the imminent loss of his 12k per month salary

    The DUP have always argued that Brexit was an all-UK decision, not one for Norhern Ireland to make on its own. Now they are caught out, because it is obvious that the people of the UK just want it done and want to move on. Nobody in their right mind wants more agonising and divisive controversy about Brexit. If the deal fails in the Commons by a margin of 10 or fewer, the DUP should and will never be forgiven by the Irish or British people.

    He will have a difficult job trying to get enough votes, the DUP will influence a certain number of MPs who are doddering and that could kill the whole thing. However, if this is voted down then I fear that that is the end of discussions, and a crash out is inevitable, Hopefully not.
