Court ruling: Media free to report Dáil comments about Denis O'Brien's debts
Judgement in the O’Brien versus RTÉ is also likely tomorrow.

THE HIGH COURT has said that an injunction granted in favour of businessman Denis O’Brien was not intended to restrict the reporting of utterances in Dáil Éireann.
Judge Donald Binchy said today that it was never the intention that any order made by the court would restrict the right of Dáil deputies to speak as they see fit or the entitlement to report it fairly.
In effect, it clarifies the media’s right to freely publish statements made in the Dáil by independent TD Catherine Murphy about businessman Denis O’Brien’s finances.
The judge’s ruling came as Denis O’Brien’s legal team raised its intention to make an application to the High Court seeking to clarify the ‘demarcation’ between the respective roles of courts and Oireachtas.
RTÉ and the Irish Times were represented in the High Court to seek clarification on their abililty to report Murphy’s comments in the Dáil.

It follows an injunction granted in favour of the businessman against the broadcaster in relation to details of his debts to IBRC, the former Anglo Irish Bank.
O’Brien’s legal team led by Michael Cush SC told the High Court that it was never their intention to stop TDs from making comments in the Dáil.
David Holland SC for RTÉ described the position of O’Brien’s legal team as a “spectacular climb down”.
O’Brien’s legal team had warned reporters, including TheJournal.ie, following our publication of Murphy’s comments in the Dáil on Thursday that publishing the comments would be a potential breach of the temporary injunction obtained on 21 May.

Catherine Murphy TD welcomed the clarification from the High Court this afternoon saying it vindicates the rights of elected representatives and the media.
“The substance of my concerns has always been to have a full, competent & independent inquiry into the wider governance issues in IBRC & I will continue to pursue that through the appropriate democratic channels available to me in the Oireachtas,” she said.
A Government spokesperson also welcomed the ruling this evening:
The right of Oireachtas members to exercise privilege is constitutionally protected and this has been reaffirmed by the Judge. It is important that right is exercised responsibly and in the public interest and that the media are free to report fairly on such statements.
RTÉ’s managing director of news and current affairs Kevin Bakhurst said the ruling sent an important message about the rights of the media to report privileged comments in the Dáil.

The media were restricted from reporting some details of the 21 May injunction judgement. Legal teams for O’Brien, RTÉ and IBRC returned to court this afternoon to discuss what elements of the judgement could be made public.
Darren Lehane on behalf of O’Brien argued for a number of elements from Judge Binchy’s judgement to be redacted. He described these requests as ‘minimalist’.
The arguments were opposed by David Holland SC who said that an “avalanche of information” had come into the public domain in recent days and that this needs to be considered.
He said that public comments on behalf of O’Brien which accused Catherine Murphy TD of being a liar have “changed this whole case into an entirely different realm of public interest.”
Holland requested that the judge consider this when deciding on redactions.
The parties will return to court tomorrow morning with Judge Binchy saying the public interest in the case means he would like the judgement to be made as soon as possible.
In a statement this evening, RTÉ welcomed the judgement.
“Judge Donald Binchy publicly acknowledged it was entirely understandable that RTÉ brought the application to the court to get necessary clarity,” it read, adding that the judge “previously granted an injunction against RTÉ preventing it from broadcasting any confidential information of Denis O’Brien’ personal banking details with IBRC which remains in place.”
It concluded:
Most importantly, RTÉ very much welcomes the fact the judge clarified that both comments made in the Dáil in the past and future comments in the Dáil are covered by privilege, and that media, including RTÉ are free to report them.

Its easy to see who fg/lab and especially our taoiseach side with . Ednas silence on this issue leaves no doubt that he values DoB far more than our democratic principals. It has of course been obvious up to now any way when you look at what Obrien has gotten away with in this country over the last 2 decades.

No he can’t. I read the transcript of yhe discussion between him and Micheál Martin which is to go out on radio. Apparently he was asked if he had seen the documents he said we’re altered and he said he hadn’t! So the next question not surprisingly was, “how do you know then that they were altered?” All he could say was that they had been.

And they were also ALWAYS free to report it. Article 15 of the constitution clearly states so, and Article 34 decrees that judges cannot make rulings which conflict with the constitution.

In my opinion, it seems the supposed national broadcastor RTÉ self censored throughout this saga. It seems to have suited them to be champions of freedom of speech, albeit unsuccessfully. RTE allowed their airwaves to be used to accuse a TD of making false statements under Dáil privilege, without relaying the original statement; remarkable stuff altogether.
Separately the Taoiseach was mute while his parliament was effectively gagged – yet what authority can a gagged parliament have?
This has been an unprecedented constitutional crisis where the only Irish agents of constitutional protection and information have been Catherine Murphy TD, Broadsheet.ie, and Village Mgazine: hats off to them, they have done us citizens no small favour.

Noonan employed some ex-HSBC employees in positions here. Just in case our lot weren’t dodgy enough he brought in 2 guys who were senior execs when HSBC was used by drug cartels and rogue states. Both gone now but it’s doubtful we’ll ever see that HSBC tax evader list, after they left their mark.

You should hold your readership in less contempt. We’ve been saying this for days and been blocked, ignored, deleted. In the process you’ve sacrificed a lot of respect and are now seen more as entertainment than serious news. This has been a disaster for you and you need to engage with us and explain how such a supine attitude to major news stories will not be part of your editorial policy in the future.
If it’s a proper news organisation I expect them to have the kind of lawyers that get it right. The Sunday Times and others did, so clearly it was possible.
It’s a huge missed opportunity for them, to have left CM comments up in defiance of the court, safe in the knowledge it would never have been upheld would have been legendary journalism. Their solicitors should have informed them it would never stand up in court. They could have ridden the wave of this crisis as constitutional defenders and became a trusted household name. Every crisis is an opportunity and all that.
I would like to know why the supposed leader of this country has FAILED to address the accusation that Denis O’Brien ‘may’ have received favorable loan rates supported by the tax payers of this country.
Answer that, and then we can talk about whether Enda is one of the 350 Irish people with the secret Swiss HSBC accounts.

I think the real issue here was ‘missed’ by the media. Well they would miss it! The issue is the fear of the media in publishing the Catherine’s Murphy’s comments once Denis O’Brien flexed his legal muscles. Michael Mc Dowell said it was “absurd” to think the media ‘could’ be stopped from publishing utterances under Dail Privilege. Of course it was! But RTE, who weren’t included in the ruling declined to broadcast the contents of the speech , under legal advice! Makes me wonder what else the media in general is afraid to publish!
And that is true. Denis Maxwell Archer O’ Brien’s legal team called Murphy a liar, albeit in a flowery way….and they should be held to account for that also, as well as the attempt to suppress, thru fear of legal action, information of public interest. Thundering disgrace:-)
It’s ironic that if a citizen does not sign up for Irish Water, a private company/quango, that company gets access to their revenue details, council details, and any other government details they want.
If DOB is thought to have been involved in possible illegal activity all of a sudden its all about privacy and protecting average ‘citizens’ privacy.
Where were DOBs solicitors when Irish Water started going through the records of everyone in this country? Do they think allowing Irish Water access to Revenue records of private citizens is an abuse of privacy? I would love to hear how they ration that.

Why is there still NO link to Catherine Murphy’s speech on Journal.ie or at least an extract about the 1.25% rate that O’Brien got on his loan instead of the 7% he should have been charged and no mention of the conflict of interest of KPMG essentially policing themselves in the review of the matter. This article is a fudge- reporting that you CAN say something is not the same as actually saying it. Please say it. You are my primary news source and while I understand that you do not have the budget of RTE it would be nice to know for instances- were you threatened by legal action by Denis O’Brien and his legal team? I think both you and RTE and Irish Times have lost a huge amount of reputation damage due to this case and I believe you have a case to counter sue him collectively over his legal threats and exploiting the legal ambiguity over the weekend. We essentially had a media coup in this country and unless challenged by all parties involved will only get worse. Mr.O Brien’s comment about the authenticity of ms Murphys statement reminds me of the most famous retort by a witness I’m these islands: “he would say that wouldn’t he’! ( Perfumo affair)

Whatever the rights and wrongs of this particular issue ( I have been away for most of the last 10 days and have not followed it closely enough to form an educated opinion, so just steering clear), It’s clear that whatever this individual does, he can do no right in the eyes of the Irish public. Read an article on him in an american magazine a few months ago. Was interesting, he does employ thousands of people worldwide and built and opened something like 150 schools in the Carribean in the last couple of years. Sometimes we do live in a bit of a fishbowl in Ireland and outside perspective is always useful. No doubt I will set a daily record for red thumbs but all arguments should have a counter balance no matter how unpopular!

Since late last week politicians of all persuasions have sprung out of the woodwork and said it is “essential for a democracy” for TDs to be allowed to say things under privilege and for them to be reported by the media. Does it not matter whether what is being said is true or false? Does it not matter if there is a court order in place? I agree that Dáil privilege is an important component of our democracy; however, there is a parallel duty of care on the TDs and Senators to use this privilege with integrity under the guidance of the Ceann Comhairle. If there was respect for court orders we wouldn’t be in the position we are in. A position which has been created entirely by Deputy Murphy’s deliberate breach under Dáil privilege of a court order of which she was aware.
I quite like and admire Mr O’Brien. He had dragged himself up and made a billion. He has employed thousands of Irish people over the years both at home and abroad. He has used his clever acumen to succeed by whatever means possible. He won’t be the last man in Ireland to exploit what he can.
people seem to be comparing Kenny’s dignity as Taoiseach, respect of the Judiciary and rightly not entering the fray, with the bandwagon crew of eejit TDs trying to pre-empt an inevitable court clarification that Dail privilege obtains.

Had Kenny, as head of state, entered the debate and tried to express his advance opinion on what the courts should decide, then we’d really be in trouble.
